When can I enroll?

The secure enrollment website https://bryancave.hubinternational.com is currently open for the December 1, 2024 – December 1, 2025, term. The deadline to enroll is November 30, 2024

Who is included within the group policy as a covered person? 

The covered person means the individual named on the participant list and that person’s spouse, domestic partner, and any relative related by blood, marriage, or adoption, who is a resident of the same household.

Are my children, who are away at college, covered under my personal excess liability policy?

Yes, as long as they are under the age of 25 and maintain that your household as their primary residence when not at college. Note: if they have their own insurance, their policy should also be written with the required underlying limits or there will be a self-insured gap.

What is the limit of coverage provided for each participant? 

Each participant is covered for the limit selected and shown on the participant list & certificate. Coverage can be purchased for limits of $1,2,3,5, or 10 million. In addition, the defense costs are unlimited and do not reduce the liability limit available for settlement of a judgment.

What are the minimum limits that I must maintain for my primary coverage?

What are the consequences if I do not maintain the required underlying limits?

You will be self-insured (uninsured) for the gap between your maintained limit and the required underlying limit. In some instances, (e.g. – vehicles or watercraft owned, rented, or borrowed for longer than 60 days) underlying coverage is required for coverage under the GPEL to apply.

Can I keep my current umbrella policy in effect if I participate in this program?

Due to the “other insurance’ clause, we do not recommend that you maintain two Excess Liability policies. If you are involved in a personal lawsuit, both liability insurers will pay their proportionate share of the settlement, but differences between the contracts could result in coverage differences and the limits might not stack.

What is excess uninsured/underinsured motorist coverage, and why is it so important?

Should you or a member of your family be involved in an accident with an uninsured/underinsured driver, this coverage will reimburse you for the damages you should have been able to collect from the other driver’s insurance, i.e.: loss of income/future earnings, short term/long term medical expenses, pain and suffering. Also, this coverage would respond if you or a family member were injured by an uninsured/underinsured driver as a pedestrian or in a “hit and run” occurrence.

Is coverage included while serving as Director of Office of a non-profit organization?

Yes. Coverage is included for personal injury or property damage claims arising from activities as a Director or Officer of a non-profit organization, or to a homeowner, condominium or cooperative association. (Fiduciary liability is not covered, however).

Is coverage for professional and business activities included?

Professional activities are not included in coverage, but incidental business activities covered by a personal (homeowner or automobile) liability policy are covered on a “follow form basis, subject to the limitations stated in the policy under “business pursuits.”

If a house is rented to a third party, is the property covered?  And if the title is owned by an LLC?

If the rental property is a 1 or 2 family home or condo unit, it is covered on a follow form basis over the primary liability policy. If the property is titled to an LLC, be sure that you are listed on the primary policy as the 1st named insured and the LLC is listed as either a 2nd named insured or an additional insured.

Am I covered for vehicles not registered for road use (minibike, moped, golf cart, etc.)?

Check your homeowner policy to be sure that it provides Comprehensive Personal Liability coverage for unlicensed recreational vehicles. If not, a policy must be purchased to provide the required $300,000 primary limit.

I race my boat on the weekends. Am I covered?

Yes, but only if you are racing a sailboat. Coverage is not provided for any car, motorcycle, recreational vehicle or other watercraft while practicing for or taking part in a competitive race.

I own/rent an aircraft and pilot it as a hobby. Am I covered?

No. Coverage is not provided for the ownership, maintenance, or use of any aircraft. However, this does not apply to an aircraft chartered by the insured with a pilot and crew.

Is personal injury included?

Yes. Personal Injury means: (a) Bodily injury, shock, mental anguish, mental injury, sickness or disease, including death; (b) Injury because of false arrest or imprisonment, malicious prosecution, wrongful entry or eviction, libel, slander, defamation of character or invasion of privacy.

Can the policy be converted to an individual personal umbrella policy if I leave the firm?

No. The policy is not convertible. The participant would have to replace coverage on an individual basis. The policy will terminate upon the expiration date and no renewal will be offered.
